Confirm Contract Type

Contract Types Explained:
A Permanent Contract is issued where no end date is specified.
A Fixed Term Contract is issued where a person is employed for a limited but definite period of time.
A Specific Purpose Contract is issued where a person is being employed on a specific project or replacing someone who is absent.
A Temporary Contract
is issued where a person is being employed for a limited period of time.
A Casual Contract is issued where there are no fixed hours of work.

Employees are entitled to;

  • A 15-minute break where more than 4.5 hours have been worked.
  • A 30-minute break where more than 6 hours have been worked, which may include the first break.
  • A daily rest period of 11 consecutive hours per 24 hour period.
  • A weekly rest period of 24 consecutive hours per seven days, following a daily rest period.

Payment for breaks is not a statuatory entitlement.

From 1 December 2022, the Payment of Wages (Amendment) (Tips and Gratuities) Act 2022, introduced new rules as to how employers have to share tips, gratuities and service charges amongst employees.

Confirm Sick Pay Arrangements

The Sick Leave Act of 2022 provides a statutory sick pay scheme for all employees to a rate of 70% of their usual daily earnings to a maximum of €110 a day for certified leave only. The annual entitlement is 3 days (2023), 5 days (2024), 7 days (2025) and 10 days (2026).

Confirm Termination and Notice Required:

Employees who have been in continuous employment for at least 13 weeks are obliged to provide their employer with one week’s notice of termination of employment.

If a greater amount of notice is required by the employer then this must be specified in the employee’s contract.

It is recommended that employers include a clause in their contract allowing for the company to pay the employee in lieu of notice in the event of a termination situation.

Retirement Age

There is no statutory retirement age. However, some employers may wish to set a retirement age in the contract of employment. 65 is generally the age most people retire at. The State Pension age is 66.
