Hybrid Working

Hybrid working is a form of flexible working where workers spend some of their time working remotely.

Rest Breaks

Employees are entitled to;

  • A 15-minute break where more than 4.5 hours have been worked.
  • A 30-minute break where more than 6 hours have been worked, which may include the first break.
  • A daily rest period of 11 consecutive hours per 24 hour period.
  • A weekly rest period of 24 consecutive hours per seven days, following a daily rest period.

Payment for breaks is not a statuatory entitlement.

Annual Leave

Statutory Annual Leave Entitlements:
Employess are entitled to 4 working weeks in a leave year (where the employee works at least 1,365 hours)

Sick Pay Arrangements

The Sick Leave Act of 2022 provides a statutory sick pay scheme for all employees to a rate of 70% of their usual daily earnings to a maximum of €110 a day for certified leave only. The annual entitlement is 3 days (2023), 5 days (2024), 7 days (2025) and 10 days (2026).

Termination and Notice Required:

Employees who have been in continuous employment for at least 13 weeks are obliged to provide their employer with one week’s notice of termination of employment.

Notice periods greater than 1 week must be specified in the Employees Contract.

Employers Minimum Notice Requirements

Employers must provide employees a mininmum notice of termination based upon their length of service –

Length of Service

Thirteen Weeks to Two Years – 1 weeks notice.

Two to Five Years – 2 weeks notice.

Five to Ten Years – 4 weeks notice.

Ten to Fifteen Years – 6 weeks notice.

More then Fifteen Years – 8 weeks notice.

Payment in Lieu of Notice:

It is recommended that employers include a clause in their contract allowing for the payment in-lieu of notice, in the event of an immediate termination situation.
